Scotland releases 139 prisoners early to ease overcrowding, per new law.
Scotland is releasing 139 prisoners early this week to address record prison overcrowding, with the population reaching 8,431—over 600 above capacity.
The emergency measure, enabled by the Prisoners (Early Release) Scotland Act 2025, allows short-term inmates serving less than four years and who’ve completed 40% of their sentence to be released, excluding those convicted of sexual offences or domestic abuse.
Up to 990 inmates may be released by April 2026 in phased batches.
Justice Secretary Angela Constance said the move is necessary for safety, citing risks to staff and inmates, and emphasized the releases are part of a broader effort to build a more sustainable justice system.
