Kenya’s data watchdog ordered Liquid Telecom Kenya to pay $6,500 to a former employee for unlawfully recording, keeping, and sharing his call without consent.
Kenya’s Office of the Data Protection Commissioner ruled that Liquid Telecom Kenya must pay former employee Andrew Alston Sh700,000 for violating his data rights by recording a heated post-retrenchment call in 2024 without consent.
Despite Alston’s explicit request to delete the recording, the company retained and shared it with a sister company for use in a South African arbitration case, which ultimately did not use the recording.
The ODPC found the company unlawfully processed his personal data, failed to honor his erasure request, and breached data protection principles under Kenya’s Data Protection Act.
The decision emphasizes the importance of consent and respecting data subject rights, particularly in sensitive employment contexts.
