A bid to declare former staffer Brittany Higgins bankrupt has been delayed due to a technical error in court paperwork, stalling efforts by ex-Liberal senator Linda Reynolds to recover over $1 million in legal costs after a defamation win.
Reynolds was awarded $315,000 in damages plus interest and 80% of her legal fees following a court ruling that found Higgins made 26 false or misleading statements about her, including claims of harassment and mishandling a 2019 rape allegation.
The court also upheld a separate finding that Higgins was likely raped by Bruce Lehrmann, a verdict Lehrmann is appealing.
Higgins, who received $2.4 million in taxpayer-funded compensation, has not paid any of the judgment, prompting allegations she is hiding assets through a trust.
Her husband, David Sharaz, was also ordered to pay $85,000 in damages and costs.
The bankruptcy case will return to court next Tuesday.
