Australian court orders mining exec Williams to pay $3M in solar farm loan dispute.
A mining executive, Gary Alexander Williams, has been ordered by Australia’s Supreme Court to pay $3 million in a loan dispute tied to a failed solar farm project in the Upper Hunter region.
The loan, made by Delany Advertising and Media—owned by Rohan Delany—was guaranteed by Williams, who claimed a verbal agreement required other guarantors be pursued first, a condition he said was discussed on the Gold Coast.
Justice James Hmelnitsky rejected Williams’ arguments, finding no credible evidence of the alleged agreement and ruling that the four-year delay and lack of default notice did not invalidate the claim.
The court upheld the loan’s enforceability, requiring Williams to pay the remaining balance after the secured land was sold for $2.02 million, with interest and legal costs to be determined.
