Irish ex-soldier’s sexual assault conviction upheld; court rejects memory loss claim.
Richard Muldarry, a retired Irish Defence Forces member, has had his conviction upheld by the Court of Appeal for sexually assaulting two colleagues in November 2021 at a military base.
The court rejected his claim of concussion-induced memory loss and dismissed challenges to the trial’s evidence, including the admission of prosecution expert testimony and exclusion of injury photos.
He was originally sentenced to a six-month suspended sentence, five days of detention, and fines for the assaults and misconduct.
The ruling affirms that personal health issues do not excuse criminal behavior in sexual assault cases.
