The Court of Appeal heard that Kelly, who has 12 prior convictions and pleaded guilty to armed robbery and firearm possession, faced an initial eight-year sentence, reduced by two years.
Defence lawyers claimed the judge failed to consider a probation report and overemphasized emotional victim impact statements, while prosecutors maintained the sentence reflected the severity and persistence of the threats.
The appeal focuses on whether the judge’s reasoning crossed legal boundaries by assigning direct responsibility for the suicide.
A decision is expected in November 2025.
