Florida's House Bill 197, passed by a committee, would require all private employers, including small businesses, to use the federal E-Verify system to confirm employees' work authorization, expanding current rules that only apply to firms with 25 or more workers.
Sponsored by Republican Rep. Berny Jacques, the bill aims to strengthen enforcement against hiring undocumented workers, citing E-Verify’s efficiency and accuracy.
Critics, including Democratic Rep. Anna Eskamani, warn it could worsen labor shortages, especially in agriculture and other hard-to-fill jobs, and place added burdens on small businesses.
Violations could lead to fines of up to $1,000 per day after three infractions within two years.
The bill now moves to a final committee before a potential full House vote, with no Senate companion bill and the next legislative session not starting until January 2026.
