A conservative group sued Trump over 2025 tariffs, claiming they exceed presidential power, and the case is now before the Supreme Court.
A conservative nonprofit, the Liberty Justice Center, has sued former President Donald Trump over his sweeping 2025 tariffs, arguing they exceed constitutional and statutory limits on executive power.
The group, which defends individual rights and government accountability, claims the tariffs violate the nondelegation doctrine and the International Emergency Economic Powers Act.
The case, backed by legal analysis from a George Mason University professor, was initially ruled illegal by a unanimous panel in the Court of International Trade, a decision upheld by the Federal Circuit Court of Appeals, though the tariffs remain in effect during the appeal.
Now before the U.S. Supreme Court, the case is seen as a pivotal test of presidential authority in trade policy, with former Acting Solicitor General Neal Katyal representing five small businesses across diverse industries.
