James Hayes sentenced to 40 years without parole for sexually abusing a 9-year-old niece.
James Alan Hayes, 51, of Guntersville, was sentenced to 40 years in prison without parole or good-time credit after pleading guilty to two counts of sexual abuse of a child under 12.
The sentence, the maximum allowed under Alabama law, was handed down by Circuit Judge Matt Elliott on November 3, 2025.
Hayes had confessed in September 2024 to molesting a 9-year-old family member and entered a "blind" plea, meaning the sentence was set by the court without a prior agreement.
The victim, still struggling emotionally, continues to endure trauma.
District Attorney Jennifer Bray acknowledged Hayes’ confession but stressed it did not reduce the severity of the crime or the need for the harshest penalty.
Hayes will remain incarcerated until he is nearly 92 or dies, whichever comes first.
