U.S. Supreme Court lets stand ruling that pink color for hip implants is functional, not trademarkable.
The U.S. Supreme Court has declined to review a lower court ruling that upheld the cancellation of CeramTec GmbH’s trademark for a pink color used in ceramic hip implants, allowing CoorsTek Bioceramics to continue marketing its pink implants.
The decision, based on the color’s functional origin in a chromium oxide additive that enhances durability, reinforces that functional features cannot be monopolized via trademark law.
CoorsTek, which has produced the implants since 2014, says the color aids surgical visibility and contributes to better patient outcomes.
With over six million units sold globally, the ruling supports competition and innovation in orthopedic implants.
