India's top court backs FSSAI's ban on non-medical drinks using "ORS," citing public health risks.
The Delhi High Court has upheld India's FSSAI ban on using the term "ORS" on non-medical beverages, ruling that misleading labels pose a serious public health risk and must not be overridden by commercial interests.
The court emphasized that only products meeting World Health Organization standards can legally be called ORS, and rejected Dr. Reddy's Laboratories' request to sell existing stock, though it allowed the company to formally seek FSSAI’s approval for unsold inventory.
The decision reinforces FSSAI’s authority to regulate health-related product labeling to prevent consumer deception.
A detailed judgment is pending.
