Delhi High Court allows 79-year-old U.S. witness to testify via secure video in arms deal case.
The Delhi High Court has overturned a lower court’s 2023 decision, allowing the CBI to record the testimony of 79-year-old U.S. witness C Edmonds Allen via video conference from the Indian Consulate in New York in an Official Secrets Act case involving arms dealer Abhishek Verma.
Justice Sanjeev Narula ruled that electronic testimony is permissible under the OSA when secure, in-camera procedures are used, citing Allen’s age, health, and safety concerns as valid reasons to avoid travel.
The court approved a controlled, encrypted video link with no recording or copying, classified documents shown via secure view-only feeds, and certified copies transmitted through diplomatic channels under sealed custody.
The High Court set aside the trial court’s order and directed coordination with the Ministry of External Affairs and the Consulate to complete the examination promptly.
