UK official criticizes Scotland’s deposit scheme rollout over undisclosed risks, citing business losses and delays.
Former UK Secretary of State Alister Jack accused the Scottish Government of being "utterly irresponsible" for not disclosing risks to its deposit return scheme, particularly the potential UK-wide ban on glass bottle exemptions under the Internal Market Act.
He testified that businesses, including Biffa Waste Services, were misled by a 2022 letter from minister Lorna Slater that expressed confidence in the scheme’s launch without clearly stating the plan depended on an unsecured IMA exemption.
Biffa is now suing for £166 million over the delay.
Slater defended the letter as accurate and not intended to persuade investment, saying the exemption risk was known.
Jack cited over 1,000 business complaints and warned of economic and consumer impacts, especially during the cost-of-living crisis.
The UK-wide DRS is not expected before 2027.
