The NFL has asked a Nevada state court to dismiss Jon Gruden’s lawsuit, which stems from the 2021 release of his racist, misogynistic, and homophobic emails.
The league argues Gruden cannot dispute writing the messages, which were not altered, and that the public disclosure constituted protected speech under Nevada’s anti-SLAPP law.
The case was returned to state court after the Nevada Supreme Court rejected earlier NFL attempts to dismiss it or force arbitration, ruling the arbitration clause was unconscionable.
Gruden, a former NFL coach and ESPN analyst, claims the selective release of the emails damaged his career and endorsement prospects.
The legal battle continues in state court.
