Two Melbourne restaurants, Cafe Di Stasio and Citta, face potential closure over a combined tax debt exceeding $1 million, with the Australian Taxation Office set to argue the case in Federal Court on October 31 and November 7.
The St Kilda location owes $200,000, the CBD site over $710,000.
Owner Ronnie Di Stasio has not commented amid the legal proceedings but confirmed operations continue.
This follows a 2017 Fair Work Ombudsman finding that six foreign workers were underpaid, including a casual chef underpaid nearly $800 for a 54-hour week.
The investigation revealed violations of pay and recordkeeping laws, with five workers on 417 or 457 visas.
Allegations of a $500 weekly kickback to retain a visa were denied by Di Stasio and his partner, who later entered an enforceable undertaking to avoid court.
