Canada’s top labor board backs government’s strike-breaking order at Canada Post, saying it doesn’t violate rights.
The Canada Industrial Relations Board has upheld a government back-to-work order issued during a Canada Post strike in December 2024, rejecting a challenge by the Canadian Union of Postal Workers.
The board ruled that the federal government’s use of Section 107 of the Canada Labour Code, which suspends strikes and transfers disputes to arbitration, does not violate Charter rights, noting the right to strike is not absolute.
One member dissented, calling the intervention politically driven.
The union has since sought judicial review, but no decision has been made.
Section 107 has been increasingly used by the Liberal government in recent years across key sectors.
