A federal judge has ordered the Department of Homeland Security to remove nine social media posts related to U.S. Rep. LaMonica McIver’s prosecution, calling them prejudicial and potentially damaging to her right to a fair trial.
The posts, which labeled her May 9 visit to a New Jersey detention center a “reckless stunt,” contradicted her claim that it was lawful congressional oversight.
Judge Jamel Semper criticized the statements as inaccurate and directed the government to release additional video footage and consider a motion to dismiss based on constitutional oversight rights.
McIver, a New Jersey Democrat, faces three counts including assaulting federal officers, denies the allegations, and was accompanied in court by fellow lawmakers and Newark Mayor Ras Baraka, who was arrested during the protest and later had charges dropped.
The case is ongoing, with scrutiny over interim U.S. Attorney Alina Habba’s appointment.
