Supreme Court lets stand ruling allowing public land access via private land corners in seven Western states.
The U.S. Supreme Court declined to hear a Wyoming case over "corner crossing," upholding a 2023 10th Circuit ruling that allows recreationists to cross private land corners to access public land in checkerboard patterns.
The decision, which applies to Wyoming, Utah, Colorado, New Mexico, Oklahoma, Kansas, and parts of Yellowstone National Park, confirms that such crossings do not constitute trespass, even if they involve private airspace.
The case stemmed from a 2021 incident where four Missouri hunters crossed a private corner in Carbon County.
The Supreme Court provided no explanation for its refusal to review the case, leaving the 10th Circuit’s precedent intact.
The ruling is a win for outdoor recreation advocates but does not affect states outside the 10th Circuit’s jurisdiction.
