A Detroit judge has ordered the release or bond hearing within seven days for Jose Contreras-Cervantes, a 33-year-old Michigan man with life-threatening leukemia, ruling that detaining him without assessing flight or danger risk violates due process.
The decision, part of an ACLU lawsuit on behalf of Contreras-Cervantes and seven others, challenges a Trump-era policy denying bond to non-criminal immigrants who entered illegally.
He was arrested in August during a traffic stop, spent 22 days without cancer medication, and is now receiving substitute treatment in Baldwin, Michigan.
The Justice Department defended the policy, arguing the case should be in immigration court, but it’s unclear if it will appeal.
A status update is due by October 27.
