An Irish garda was denied a claim for about €82,571 in lost earnings, including overtime and allowances, after a two-year suspension following an April 2021 incident.
The Labour Court upheld the suspension policy, stating it only guarantees basic pay during suspension, not additional compensation.
Although the garda was cleared of criminal charges in 2023 and the court acknowledged procedural flaws—such as lack of transparency and missed job opportunities—it ruled no further pay was owed under existing rules.
The court recommended €5,000 in compensation for process failures but affirmed that the policy does not allow exceptions.
The decision follows an appeal by An Garda Síochána against a prior recommendation for compensation.
