West Virginia rules utilities—not ISPs—must pay to replace unsafe poles for broadband expansion, effective Oct. 15, 2025.
The West Virginia Public Service Commission has ruled that utility companies, not internet service providers, must pay for replacing aging or unsafe utility poles during broadband expansion.
The decision, effective October 15, 2025, requires pole owners to proactively identify and replace "red-tagged" poles—those deemed unsafe due to age, damage, or deterioration—regardless of whether a new broadband provider is attaching equipment.
The PSC emphasized that failure to act delays critical broadband deployment, threatens federal funding, and undermines efforts to expand high-speed internet in underserved areas.
The ruling follows disputes between broadband providers and utilities and prohibits using pre-existing violation policies to shift replacement costs to ISPs.
The commission also established a Pole Attachment Working Group, mandated annual reporting, and called for a statewide pole inspection database to improve transparency and efficiency.
