A judge ordered the DOJ to return a key federal vehicle from Maine to Chicago for trial in the case of Marimar Martinez, accused of ramming a police car during protests.
A federal judge has ordered the DOJ to return a federal vehicle involved in a October 4 Chicago incident to the city for trial, after it was moved over 1,000 miles to Maine.
The vehicle is key in the case against Marimar Martinez, a 30-year-old accused of ramming a law enforcement car during protests, leading to her being shot five times.
Martinez, who pleaded not guilty, claims body camera footage shows a federal agent swerved into her car.
Her attorney argued the move compromised evidence, prompting the judge to rule the vehicle must be returned on a flatbed truck for physical inspection.
A second suspect, 21-year-old Ruiz, also faces the same charge and has pleaded not guilty.
A trial date will be set at a hearing on Monday.
If convicted, Martinez could face up to 20 years in prison and a $250,000 fine.
