At least 27 states, primarily led by Republican governors, have shared sensitive SNAP recipient data—including names, Social Security numbers, and benefit amounts—with the USDA since late July, following a Trump administration demand tied to an executive order on fraud prevention.
Democratic-led states and the District of Columbia resisted, calling the request unlawful and potentially abusive, citing privacy and surveillance concerns.
On October 15, 2025, a federal judge issued a preliminary injunction blocking the USDA from penalizing noncompliant states or withholding billions in SNAP funding, ruling the data request likely violates the SNAP Act.
The USDA has not responded to requests for comment.
The move comes amid historic funding cuts and new eligibility rules under a recently signed tax and spending bill.
