A New Zealand man, Sebastian Marinkovich, was fined $2,000 and ordered to have his two dogs destroyed after they attacked a fur seal for 30 minutes on Kina Beach in September 2024.
The incident occurred in an off-leash dog area near Motueka, where Marinkovich’s dogs, a retriever/labrador cross and a German shepherd/Siberian husky cross, severely injured the seal despite his presence.
He claimed he failed to intervene, believing the attack would end the seal’s suffering.
The Department of Conservation prosecuted him under the Dog Control Act, which mandates destruction of dogs involved in attacks on protected wildlife.
The court upheld the penalty, citing the dogs’ fatal injuries to the seal.
Over the past five years, DOC has recorded 75 similar incidents involving seals or sea lions.
The case underscores the legal responsibility of dog owners to control pets in wildlife areas, with penalties including fines up to $20,000 and up to three years in prison.
