Tasmanian Independent MP Craig Garland has been granted a restricted driver’s licence after pleading guilty to drug driving following a cannabis positive test in November 2024.
Despite a mandatory six-month suspension due to a prior drink-driving conviction, Magistrate Leanne Topfer allowed limited driving for the 355km round trip between Boat Harbour and Hobart’s Parliament House during sitting weeks, citing the lack of public transport and the hardship a full ban would impose.
Garland, re-elected in July 2025 after a snap election, argued the restriction was necessary to fulfill his parliamentary duties, noting difficulties sleeping in Hobart and high accommodation costs.
He sought a medicinal cannabis prescription for chronic pain but had not been prescribed it at the time of the offence.
A request to extend driving privileges to reach his preferred outdoor accommodation in Clifton Beach was later withdrawn.
Garland admitted to smoking cannabis the night before driving, acknowledging poor judgment but maintaining he was not impaired.
He was fined $1,096.
