Texas Attorney General Ken Paxton and the Republican Party of Texas have filed a federal lawsuit seeking to restrict Republican primary elections to only registered Republican voters, arguing that allowing independents and Democrats to participate violates the party’s constitutional rights.
The lawsuit, filed in Amarillo federal court, challenges the state’s open primary system, which permits any registered voter to choose a party’s ballot on election day.
The GOP claims that non-Republican votes have influenced outcomes, including narrow wins in recent primaries.
The case, before Judge Matthew Kacsmaryk, could reshape primary access, but experts say implementing changes would require re-registering all 18 million voters and overhauling election systems—making any shift unlikely before 2026.
