A federal judge has dismissed Drake’s defamation lawsuit against Universal Music Group, ruling that lyrics from Kendrick Lamar’s 2023 diss track “Not Like Us” are protected under the First Amendment as artistic expression.
Judge Jeannette A. Vargas stated the song’s allegations—such as accusations of paedophilia and calls for vigilante justice—were part of a public rap feud and not provable factual claims, with a reasonable listener understanding them as opinion and exaggeration.
The lawsuit, which claimed the track damaged Drake’s reputation, led to violence at his Toronto home, and harmed his brand, did not name Lamar directly.
Universal Music Group welcomed the dismissal, calling the case an attack on artistic freedom and reaffirming its support for Drake’s music.
