Kilmar Abrego Garcia, a Salvadoran man at the center of a national immigration debate, will not appear in a Nashville courtroom Friday due to insufficient time to transport him from Pennsylvania.
The hearing, ordered by a federal judge, will instead address scheduling and discovery disputes.
Garcia faces human smuggling charges from a 2022 traffic stop where eight people were found in his vehicle.
He lived in the U.S. with his American family for years before being deported earlier this year and successfully sued the Trump administration over his removal.
His legal team plans to argue the charges are retaliatory.
A follow-up hearing is set for November 3, pending no delays.
