India's Supreme Court allows couples to bypass surrogacy age limits if they froze embryos before 2021.
The Indian Supreme Court ruled that couples who froze embryos before the Surrogacy (Regulation) Act, 2021 took effect may bypass the law’s age limits—women 23–50, men 26–55—because their right to surrogacy was established when they froze embryos under prior laws.
The court, led by Justices BV Nagarathna and KV Viswanathan, said the right to parenthood crystallized at embryo freezing, making age limits inapplicable retroactively.
The decision allows three couples who had already begun the process to proceed with surrogacy, emphasizing reproductive autonomy and fairness.
The ruling does not change current age rules for new applicants but ensures prior legal steps aren’t invalidated by later legislation.
