The Netherlands’ Supreme Court has upheld a freeze on F-35 fighter jet component exports to Israel, requiring the government to reassess the license within six weeks due to concerns the equipment could be used in violations of international humanitarian law.
The court ruled that only the foreign minister, not the judiciary, can determine the risk of serious breaches, rejecting a lower court’s decision that had halted exports.
Foreign Minister David van Weel said resuming exports is unlikely given the situation in Gaza, where over 66,200 Palestinians have died, according to Gaza’s Health Ministry.
The case, brought by Dutch human rights groups in late 2023, argues that supplying F-35 parts could make the Netherlands complicit in potential war crimes.
Israel denies committing war crimes, citing self-defense.
The Netherlands is the first EU member to take such a legal step, following similar actions by the UK and Spain.
