A federal judge in Tennessee has suggested the Trump administration may have targeted Salvadoran immigrant Kilmar Abrego Garcia for vindictive reasons, citing evidence that his prosecution followed a high-profile legal challenge and a wrongful deportation.
The judge noted that top officials' statements, including from Homeland Security Secretary Kristi Noem and Attorney General Pam Bondi, along with a deputy attorney general’s admission that the investigation began after a judge criticized the government, raise concerns about retaliation.
Abrego was wrongfully deported in March, spent months in prison in El Salvador, and was returned to the U.S. in June before facing criminal charges.
While the judge did not dismiss the case, the findings signal strong skepticism about the prosecution’s motives and add to scrutiny over political influence in immigration enforcement.
The case remains ongoing.
