South Africa’s top court ruled all parents get equal paid leave, ending gender-based discrimination in parental benefits.
South Africa’s Constitutional Court has ruled unanimously that all parents, including fathers, adoptive, and surrogacy-based parents, are entitled to equal four months and 10 days of paid parental leave, declaring previous laws that granted shorter leave to fathers unconstitutional and discriminatory.
The court found the existing system violated rights to dignity and equality, particularly by reinforcing outdated gender roles.
The ruling allows parents to share leave as they choose, with mothers retaining priority for birth-related time, and eliminates a two-year age limit for adoptive parents.
The decision, effective immediately, gives Parliament 36 months to update the law, requiring employers to adjust policies and benefits accordingly.
