Quebec court approves lawsuit over smelter emissions, allowing residents to claim damages for health and emotional harm.
A Quebec Superior Court has approved a class-action lawsuit against Glencore’s Horne smelter and the Quebec government, allowing residents within 10 km of the facility since October 2020 to seek damages over harmful emissions.
The ruling permits claims related to elevated arsenic and cadmium levels, which have repeatedly exceeded provincial limits, including a 2023 annual average 15 times the legal standard.
Plaintiffs allege health risks, including cancer, and psychological distress, while accusing the government of failing to enforce environmental regulations since at least 2007.
The case seeks at least $315,000 per claimant.
Glencore says operations are safe, noting most of Rouyn-Noranda now meets ambient arsenic standards.
The claims remain unproven.
