Nevada Supreme Court denies NFL’s request, letting Gruden’s lawsuit proceed against league over leaked emails.
The Nevada Supreme Court has unanimously denied the NFL’s request for a rehearing in Jon Gruden’s lawsuit, allowing his case to move forward.
The court ruled it would be unconscionable to force Gruden to arbitrate his claims against Commissioner Roger Goodell, upholding a prior decision that the NFL’s arbitration clause does not apply to him as a former employee.
The ruling clears the way for discovery, enabling Gruden to seek documents and testimony from the league, including Goodell, to investigate allegations that the NFL orchestrated the leak of his past racist, sexist, and homophobic emails to damage his career.
While the court did not rule on whether the leaks occurred, the decision is a major procedural win for Gruden, who seeks damages and accountability.
The NFL may appeal to the U.S. Supreme Court.
