A Washington judge ruled Tacoma ICE detainees can seek bond, calling a Trump-era policy unlawful.
A federal judge in Washington state has ruled that certain immigrants detained at the Tacoma ICE processing center can request bond hearings, declaring a Trump-era policy denying such hearings unlawful.
Judge Tiffany Cartwright found the policy violates the Immigration and Nationality Act by withholding bond opportunities from non-mandatory detainees, including those with strong community ties or no criminal records.
The decision applies only to Tacoma, where bond was previously granted in just 3% of cases, and stems from a class-action lawsuit by the ACLU and Northwest Immigrant Rights Project.
While the ruling doesn’t set a national precedent, similar cases are pending in California and Massachusetts.
ICE, DHS, and EOIR did not respond, citing a funding lapse.
