Nine Entertainment has dropped its legal pursuit of Gina Rinehart over allegations she funded Ben Roberts-Smith’s failed defamation appeal, telling the Federal Court the subpoena seeking her financial records is no longer active.
The Age and The Sydney Morning Herald had sought documents related to potential support from Rinehart, who publicly backed Roberts-Smith, but her lawyers confirmed no responsive documents exist.
Roberts-Smith, a former SAS soldier, lost his 2023 defamation case after a 110-day trial and a failed High Court appeal, leaving him liable for about $2.4 million in legal costs—$1.5 million unpaid—despite paying $910,000 into court.
The total legal costs exceeded $35 million, with Roberts-Smith and Kerry Stokes’ company, Australian Capital Equity, ordered to pay $13.3 million in trial costs and $225,000 in fees.
Stokes funded the trial but not the appeal.
No enforcement actions have been taken, but bankruptcy proceedings remain a possibility if costs are not settled.
