Kevin Smith, 41, is appealing his 2023 murder conviction for the 2022 stabbing death of Daniel Pettersson, 34, in Jesmond, claiming he acted in self-defense during a kitchen altercation.
Smith, who held the knife, argues Pettersson, who was larger and had a history of hostility, aggressively entered the home and advanced toward him.
His legal team told the Court of Criminal Appeal the jury’s rejection of self-defense was unreasonable, as the prosecution didn’t rule out Smith’s genuine belief in threat.
The Crown maintains Smith was the aggressor, having drawn the knife without imminent danger, in a case tied to a love triangle and paternity dispute.
Smith was sentenced to 20 years with 15 years non-parole.
A ruling on the appeal is pending, and if murder charges are overturned, a retrial on manslaughter may follow.
