Kerala High Court blocks state probe into ED over 2020 gold case, citing lack of legal authority.
On September 26, 2025, the Kerala High Court upheld a lower court’s stay on a state-appointed judicial commission investigating Enforcement Directorate (ED) officials in the 2020 gold smuggling case, ruling that the state lacked legal authority under the Commissions of Inquiry Act, 1952, to probe a central agency.
The ED had challenged the commission, arguing it would interfere with the ongoing investigation and constituted an abuse of power.
The court agreed, maintaining the status quo and reinforcing that state governments cannot unilaterally investigate central agencies during active probes.
The decision is a major setback for Chief Minister Pinarayi Vijayan’s government, which had established the commission amid allegations of overreach in the politically sensitive case involving 30 kilograms of gold seized at Thiruvananthapuram Airport.
