Fiji's top court delays ruling in case against ex-PM Bainimarama and ex-Police Chief Qiliho over 2021 dismissals.
The High Court in Suva has delayed delivering its judgment in the case against former Prime Minister Voreqe Bainimarama and former Police Commissioner Sitiveni Qiliho, with a final ruling expected next Thursday.
Judge Justice Thushara Rajasinghe requested additional legal submissions from both sides on the constitutionality of the Acting Police Commissioner’s appointment, citing specific sections of Fiji’s 2013 Constitution.
Bainimarama faces one charge of unwarranted demand by a public official, potentially punishable by up to 12 years in prison, or 17 years if for personal gain.
Qiliho is charged with two counts of abuse of office, each carrying a maximum penalty of 10 years, also rising to 17 years if done for gain.
The allegations stem from actions in May to August 2021 in Suva, where Bainimarama is accused of threatening the job of an acting police official to force the dismissal of two officers, while Qiliho is accused of overseeing those dismissals without due process.
Both men remain on bail.
