Morgan Lange, 33, of Glenville, faces second-degree vehicular manslaughter charges after a September 8 drunk driving incident in Malta, New York, killed 30-year-old Josh Soden, a Ballston Spa resident and former high school athlete, who was struck outside Bentley’s Tavern.
Soden died nine days later after being declared brain dead, prompting prosecutors to upgrade Lange’s charge from vehicular assault and DWI.
She had a blood alcohol level of 0.12% and allegedly tried to discard an open drink and have a co-worker destroy evidence.
Lange pleaded not guilty and was released, with a court date set for October 9.
Her family plans to file a wrongful death lawsuit, potentially targeting Bentley’s Tavern over alleged overserving.
A GoFundMe has raised over $42,000 for Soden’s family.
The case is being handled in Malta Town Court.
