18 care workers’ transfer sparks legal challenge over lost pay and leave rights.
The Public Service Association has filed urgent legal action over the transfer of 18 care workers from Forward Care to the Royal District Nursing Service in Timaru, South Canterbury, arguing they should retain all pay, leave, and conditions under Part 6A of New Zealand’s Employment Relations Act.
The workers, classified as vulnerable, face potential loss of accrued annual and sick leave, with some possibly unable to use leave for up to 12 months under the new employer.
The PSA claims the process violates the Code of Good Faith and deviates from standard practices in the home and community support sector, causing stress and confusion among workers who continue providing the same care.
The case was filed with the Employment Relations Authority to ensure a seamless transition and uphold legal protections.
