A Tamworth father and son had assault charges dropped after key witness failed to appear; both were released.
A father and son from Tamworth had assault charges dismissed in local court on September 18, 2025, after the prosecution’s key witness failed to appear.
The allegations stemmed from an April 5 incident in Westdale, with the father also facing a charge of being armed with a shovel.
Both men pleaded not guilty, and while the son was self-represented due to ineligibility for Legal Aid, the defence opposed delays.
Magistrate Julie Soars denied an adjournment, leading the prosecutor to withdraw all charges and associated Apprehended Violence Orders.
The men were then released, with the magistrate stating they were “free to go.”
