In September 2025, North Dakota Supreme Court justices heard arguments over whether allowing a murder defendant’s children to testify remotely violated his constitutional right to confront witnesses.
Spencer Moen, sentenced to life in prison for killing his wife in 2023, challenged the trial court’s decision to permit remote testimony after therapists said in-person testimony would harm the children.
His attorney argued the ruling breached the Sixth Amendment, claiming the children were not in danger and that precedent for remote testimony applies only when witnesses are victims.
The court did not rule immediately, taking the case under advisement for a decision expected in a few weeks.
