Canadian immigration lawyer Hana Marku has filed a Federal Court request to challenge the government's alleged unreasonable delay in processing visa applications from around 50 Palestinians fleeing the war in Gaza.
She claims the Immigration Department blocked applicants without explanation, failed to follow its own procedures for a temporary visa program launched in January 2024, and did not provide required reference codes, preventing applications from being completed.
Despite the government's public endorsement of a UN finding that famine is occurring in Gaza, it maintains its policy only processes applications submitted before reaching a 5,000-cap limit and has called the legal challenge "futile and moot."
As of July 29, 880 Palestinians had arrived in Canada through the program, with over 1,775 approved but not yet arrived.
