A Canadian ostrich farm’s legal fight to save 400 birds from culling after an H5N1 outbreak ended in defeat, with no reprieve expected.
Universal Ostrich Farms in Edgewood, British Columbia, has fought a prolonged legal battle to prevent the culling of nearly 400 ostriches after an avian influenza outbreak.
The Canadian Food Inspection Agency (CFIA) imposed a quarantine and issued a cull order in December 2024 following positive H5N1 test results.
The farm sought exemptions and appeals, citing rare genetics and scientific value, but lost at every level, including the Federal Court of Appeal and a Supreme Court application.
Despite support from U.S. officials and offers to relocate the birds, the CFIA upheld its order.
As of September 15, 2025, the farm had requested reconsideration of the disposal order but faced slim prospects for further legal relief.
