Judge to decide if deported immigrant returns to U.S. to face human smuggling charges.

Federal Judge Paula Xinis will decide if Kilmar Abrego Garcia, a Salvadoran national wrongly deported to El Salvador, should be sent to Maryland to await trial on human smuggling charges. Abrego Garcia's lawyers argue the charges are an attempt to justify his deportation. His wife has also sued the administration to prevent his expulsion. The DOJ plans to deport him to a third country if released.
