A 37-year-old man named Setanta Helferty, found unsteady and with slurred speech near his crashed car, had his drink-driving conviction and driving ban overturned on appeal. Ennis Circuit Court Judge Francis Comerford ruled there wasn't enough proof beyond reasonable doubt to confirm Helferty was driving, despite his high blood-alcohol level. The judge noted that other evidence is needed beyond just proximity to the car.
