Massachusetts high court upholds transit housing law, but existing guidelines are deemed unenforceable.

The Massachusetts Supreme Judicial Court upheld the constitutionality of the MBTA Communities Act, a law requiring cities and towns with public transit to zone for more multifamily housing. Though the Attorney General can now enforce the law, existing guidelines were deemed unenforceable due to improper procedural rollout. Governor Maura Healey plans to issue new emergency regulations to address this issue. The law aims to increase housing availability and lower costs in the state, which ranks third in the nation for living expenses.
