A Nebraska judge has denied a motion to declare the state's death penalty unconstitutional in the case of Alias Reed, who faces two counts of first-degree murder. Reed’s attorney argued that the law is arbitrary and lacks sufficient jury involvement, but the judge ruled these issues had been addressed before. Reed is set for arraignment on January 28. His girlfriend, Kaylynn Sweazy, is also charged in the case.
