The Canada Border Services Agency (CBSA) defended its decision to detain nearly 50 containers of solar panels from Charge Solar Renewables Inc., valued at over $5 million, due to forced labor concerns. The company sued the CBSA in Federal Court, claiming the detention led to a loss of market share. The CBSA argued it acted lawfully and in "good faith," and stated it owes no "duty of care" to importers, as the law does not require border guards to consider the impacts on business interests. The shipments were eventually released in June and July.
